1. Terms of Use
These Terms of Use apply to everyone who visits or uses the HaliSite website, app or services (the “Platform”). They are operated by Fealas Ventures Limited, a company registered in Kenya (“HaliSite”, “we”, “us”).
1. Acceptance and record of acceptance
By creating an account, ticking the acceptance box, or using the Platform, you agree to these Terms and to any additional terms that apply to you (the Client Terms or the Verifier Terms) and our Privacy Policy.
Acceptance is by active tick-box (clickwrap). We record the user, the document and version accepted, and the date and time, and keep that record for the life of the account plus 6 years. When we change a document, you will be asked to accept the new version before continuing.
You must be at least 18 and able to enter a binding contract. If you act for a company, you confirm you have authority to bind it.
2. What HaliSite is: our role as a marketplace
HaliSite is an online marketplace. It connects people who need something checked or attended in person (“Clients”) with independent people who carry out those assignments (“Verifiers”).
HaliSite is not the provider of the verification or attendance work. The assignment contract is between the Client and the Verifier. HaliSite provides the technology, assignment structure, evidence standards, payment handling, reputation features and dispute assistance.
HaliSite does not employ Verifiers, does not guarantee any Verifier’s work, and is not your agent, representative, adviser, inspector, surveyor, engineer, valuer, lawyer or carer.
We apply vetting and standards in good faith, but we do not guarantee the identity, skill, honesty or availability of any user, or the accuracy or completeness of any report. Our responsibility is limited as set out in these Terms and the Client Terms.
3. Independent contractors
Verifiers are independent contractors. Nothing in these Terms creates an employment, partnership, joint venture or agency relationship between HaliSite and any Verifier, or between HaliSite and any Client.
Verifiers choose which assignments to accept, use their own means and are responsible for their own taxes, permits, insurance and conduct. The Verifier Terms set out the standards HaliSite requires for access to the Platform.
4. Services and scope
The services available are described on the Platform in the Verify and Send Me catalogues, and in Schedule A of the Client Terms. Reports describe what a Verifier physically observed at a point in time. They are not legal, engineering, financial, valuation or medical advice.
We may add, change, suspend or discontinue services, and may decline or adjust any assignment, at our discretion.
5. Accounts and security
Provide accurate information and keep it updated. Keep your login details confidential and tell us promptly of any unauthorised use. You are responsible for activity under your account.
One person, one account. Do not create accounts to evade a suspension or to manipulate ratings.
6. Prohibited conduct
You must not, and must not ask or help anyone to:
- use the Platform for anything unlawful, deceptive, unsafe or abusive, or to harass, stalk or covertly surveil any person;
- impersonate any person, or ask a Verifier to attend or sign in your name, take attendance or sit assessments for you, or act as your legal representative;
- request, offer or handle cash, high-value items, restricted or prohibited goods, or sensitive legal originals through the Platform;
- enter private property or restricted areas without permission, or record people or places where it is not allowed or without required consent;
- offer or accept bribes, or request queue-jumping or any improper advantage;
- take transactions, communications or payments off the Platform to avoid fees, for assignments first arranged through the Platform;
- submit false, edited, misleading or fabricated evidence, reviews or ratings;
- scrape, reverse-engineer, interfere with or overload the Platform, or upload malware.
7. Suspension, removal and termination
We may warn, restrict, suspend or permanently remove any account, cancel assignments, hold or withhold payments connected to a breach, and remove content, where we reasonably believe these Terms or the law have been breached, where safety or fraud concerns arise, or where required by law.
Where practical we will tell you why and, except in urgent or serious cases, allow you to respond. You may close your account at any time once open assignments and payments are settled. Provisions that by nature should survive (including liability, payment, data, disputes and governing law) survive termination.
8. Liability and loss or damage
Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud, death or personal injury caused by negligence, or rights you have under consumer protection law.
Subject to that, HaliSite is not liable for the acts or omissions of Clients or Verifiers, for decisions you make in reliance on a report, or for indirect or consequential loss, loss of profit, loss of opportunity or reputational harm.
HaliSite’s total liability to you arising from or in connection with the Platform or any assignment is limited, for each assignment, to the greater of the total amount you paid for that assignment and KES 3,500. Rules on loss of or damage to items handled in Collect or Deliver assignments are in the Client Terms.
Each user is responsible for their own conduct and for indemnifying HaliSite against third-party claims arising from their breach of these Terms or unlawful conduct.
9. Intellectual property and content
HaliSite owns the Platform, brand and software. You keep ownership of content you submit but give HaliSite a non-exclusive licence to host, process, display and use it to run the Platform, deliver reports, resolve disputes, prevent fraud and meet legal obligations. Evidence and reports are licensed to the Client for the Client’s own lawful use as set out in the Client Terms.
10. Disputes and governing law
Please contact us first at support@halisite.com so we can try to resolve any complaint. For assignment disputes, use the dispute process in the Client Terms.
If a dispute is not resolved within 30 days, the parties will refer it to mediation in Nairobi, and failing that to arbitration in Nairobi under the Arbitration Act, 1995 (Kenya) by a single arbitrator, in English. Either party may seek urgent injunctive relief from the courts.
These Terms are governed by the laws of Kenya. Subject to the above, the courts of Kenya have jurisdiction. This does not remove any right you have to complain to a regulator or to bring a claim you cannot lawfully be required to arbitrate.
11. General
We may update these Terms by giving notice on the Platform or by email. Continued use after the effective date, or acceptance of the new version where we ask for it, means you agree. If part of these Terms is unenforceable the rest continues. These Terms and the documents they refer to are the whole agreement between you and HaliSite on their subject. Contact: support@halisite.com.
2. Client Terms
These Client Terms apply in addition to the Terms of Use whenever you post or book an assignment on HaliSite as a Client.
1. How assignments work
You post an assignment, choose the service, give the location, the claim to be checked and any deadline and access details. A Verifier accepts it, or you select one. The assignment contract is between you and the Verifier. HaliSite is a marketplace and is not a party to that contract (see Terms of Use, section 2).
You must give complete, accurate and lawful instructions. The scope must be agreed on the Platform before the Verifier starts. Changes after acceptance may change the price or timing.
2. Scope and exclusions
Every service has a defined scope, and the exclusions in Schedule A apply to it. If something is not listed as included, do not assume it is. Where your needs go beyond a service’s scope, use Custom Verification or Custom Send Me and agree the scope in writing on the Platform.
You must tick the service acknowledgement for each assignment. By doing so you confirm you understand what the service does and does not cover.
3. Evidence standards and report disclaimers
Verify assignments include GPS-tagged, time-stamped photos and video and a structured findings report. Send Me assignments include the evidence agreed in the scope, such as notes, photos and a short update.
Reports record what the Verifier observed, in the places they could access, at the time of the visit. Conditions can change before or after the visit. Reports are not legal, financial, engineering, valuation, medical or other professional advice, and are not a title search, survey, structural certification, valuation, licence check or ownership check.
Do not rely on a report alone for a high-value decision. Take professional advice (for example a lawyer, surveyor or engineer) where appropriate. HaliSite may review, request corrections to, or reject evidence that does not meet the standard.
Evidence is provided for your own lawful use. You must not publish or share evidence containing identifiable people or private places in a way that breaches their rights or the law.
4. Consent and third parties
You are responsible for having the right to commission the assignment. For Visit Someone, the person being visited must have agreed to the visit, and photos or video are taken only with their consent. For Attend Something and similar services, you are responsible for confirming that attendance is permitted and that any note-taking or recording is allowed. Verifiers will observe and report and will not speak, sign, pay or commit on your behalf.
No proxy attendance or misuse. Send Me services must not be used for proxy attendance for credit or assessed attendance, to sit any test, exam or assessment, to sign a register or attendance sheet in another person’s name, to submit another person’s work as your own, or to obtain any academic, employment or other benefit by deception. Verifiers attend and report as observers, in their own name only. If we reasonably suspect misuse, we may cancel the assignment, withhold payment and suspend the account.
5. Prices, payment and holding of funds (escrow)
Prices are shown on the Platform or agreed in a quote and include HaliSite’s service fee and any applicable taxes unless stated. You pay HaliSite through the Platform when you confirm the assignment.
HaliSite holds your payment on trust or in a designated account for the assignment and releases it to the Verifier, less our fee, when the report is approved or the review window of 48 hours expires without a dispute. Do not pay Verifiers outside the Platform.
Expenses (such as transport beyond the agreed area) are payable only if agreed on the Platform in advance.
6. Cancellation and refunds
You may cancel before a Verifier accepts for a full refund. After acceptance and before the Verifier has travelled, a cancellation fee of 10% of the assignment price applies. Once the Verifier has travelled, a fee of 50% of the assignment price applies. Once the work has been done, the full price is payable.
You are entitled to a refund, or a free re-do where possible, if the Verifier does not attend, the report is materially incomplete or does not meet the evidence standard, or the assignment cannot be completed for reasons outside your control. You are not entitled to a refund because a report is unfavourable, or because conditions at the location differ from what you expected.
Refunds are returned to the original payment method within 10 business days of approval.
7. Disputes about an assignment
Raise a dispute on the Platform within 48 hours after the report is delivered, with a clear explanation and any supporting material. Funds under dispute stay on hold.
HaliSite will review the evidence from both sides, may ask for more information, and will decide whether to release, partially refund or refund the payment, normally within 7 business days. Our decision on the handling of funds is final for the Platform. It does not stop you from pursuing other remedies under the Terms of Use, section 10.
8. Loss, damage and liability
For Collect or Deliver, only low-value, non-sensitive, lawful items are permitted. You must not send cash, valuables, legal originals or restricted items. Proof of handover is required. If an item is lost or damaged while in a Verifier’s care, HaliSite will help you pursue the Verifier, and any compensation we pay (if we choose to) is capped at the lesser of the declared value and KES 1,000.
HaliSite is not liable for a Verifier’s negligence or misconduct, for decisions you make based on a report, or for indirect loss. The overall liability cap in the Terms of Use, section 8, applies. Nothing here limits liability that the law does not allow to be limited.
9. Your data and consents
By using the Platform you consent to the collection and processing of photos, video, GPS data and other evidence for your assignment, as described in the Privacy Policy. You must not instruct a Verifier to collect personal data that is not necessary for the assignment, to record people covertly, or to enter private areas without permission.
10. Conduct and suspension
The prohibited conduct and suspension provisions in the Terms of Use, sections 6 and 7, apply. We may refuse, cancel or hold any assignment or payment that appears unlawful, unsafe or fraudulent.

3. Verifier Terms
These Verifier Terms apply in addition to the Terms of Use to anyone who registers as a Verifier on HaliSite.
1. Independent contractor status
You are an independent contractor, not an employee, partner or agent of HaliSite. You decide whether to accept an assignment, how to carry it out within the requirements, and when you are available. You provide your own transport, phone and equipment, and are responsible for your own taxes, permits, insurance and compliance with the law. HaliSite does not guarantee any volume of work.
2. Eligibility, vetting and profile
You must be at least 18, have the right to work in Kenya, pass identity and background checks, and provide accurate details of your coverage areas and experience. For Visit Someone and similar services, enhanced checks may apply. We may re-verify at any time and may restrict you to the services you are cleared for. Keep your profile accurate and current.
3. Accepting and carrying out assignments
Accept only assignments you can complete safely, lawfully and on time. Follow the agreed scope. If something prevents the visit, tell the Client through the Platform immediately. Repeated no-shows or late cancellations will lower your rating and may lead to suspension.
Your safety comes first. Do not enter unsafe places, confront people, or take risks. You may stop and report where you feel unsafe.
4. Scope and exclusions you must observe
You must work within the scope and exclusions in Schedule A of the Client Terms. In particular, you must not speak, sign, negotiate or pay on a Client’s behalf, impersonate a Client, attend in their name for credit or attendance, sign any register or attendance sheet in another person’s name, sit any test, exam or assessment for anyone, give medical or professional advice, act as a surveyor, engineer or valuer, or handle cash, valuables, legal originals or restricted items.
5. Evidence standards and honest reporting
Capture evidence using the Platform tools where possible so that photos and video carry GPS and time stamps. Evidence must be genuine, unedited and taken at the location during the assignment. Follow the required checklist for the service.
Report only what you personally observed, in plain language, without opinions presented as fact. Note anything you could not access. Submit evidence and the report through the Platform by the agreed deadline. Fabricated, recycled or edited evidence will result in removal and forfeiture of pending payments.
6. Data protection, consent and recording rules
You will handle personal data only as the assignment requires and only through the Platform. You are responsible for following the Data Protection Act, 2019 and the Privacy Policy when you capture photos, video, audio or GPS data.
- Do not record people covertly. Where individuals are identifiable, get consent where required and avoid capturing them where it is not necessary.
- Do not photograph or record inside private homes, hospitals, schools, courts or other restricted places without permission from the person in charge and the Client’s agreed scope.
- For Visit Someone, take photos or video only with the visited person’s consent.
- Do not keep, copy, share or post any evidence or personal data outside the Platform. Delete local copies once the assignment is closed.
- Report any loss, theft or exposure of data or devices to HaliSite immediately.
7. Payment, fees and payouts
Clients’ payments are held by HaliSite and released to you, less HaliSite’s service fee of 15%, after the report is approved or the review window expires. Payouts are made to your verified mobile money or bank account within 1 business day for mobile money and within 3 business days for bank transfers, counted from release of funds. HaliSite may withhold or reverse payment where evidence is rejected, a refund is granted because of your failure, or there is suspected fraud or breach. You must not accept payment, tips or favours outside the Platform for Platform assignments.
8. Conduct, prohibited acts and suspension
The prohibited conduct in the Terms of Use, section 6, applies to you. Further, you must be respectful, honest and punctual, not discriminate or harass, not misuse any information you learn from an assignment, and not solicit a Client for off-Platform work.
HaliSite may warn, restrict, suspend or remove your account, and withhold payments related to a breach, in line with Terms of Use, section 7.
9. Disputes, liability and indemnity
Assignment disputes follow the process in the Client Terms. You agree that HaliSite’s decision on handling disputed funds applies. You are responsible for your own acts and omissions. You indemnify HaliSite against claims arising from your breach of these terms, negligence or unlawful conduct. Liability limits in the Terms of Use apply to HaliSite. HaliSite does not provide insurance for Verifiers. You are responsible for arranging your own personal accident, medical and public liability cover for the assignments you carry out.
10. Confidentiality, intellectual property and exit
Treat Client and assignment information as confidential. Evidence you submit is licensed to HaliSite and the Client as set out in the Terms of Use. You may stop using the Platform at any time after completing or handing back open assignments. Governing law and dispute resolution follow the Terms of Use, section 10.
4. Privacy Policy
This Privacy Policy explains how Fealas Ventures Limited (“HaliSite”) collects, uses and protects personal data. HaliSite is compliant with the Data Protection Act, 2019 of Kenya.
1. Personal data we collect
- Account data: name, phone, email, password, role (Client or Verifier), location or coverage area, profile information.
- Verifier vetting data: national ID or equivalent details, photograph, background and reference checks, payout account details.
- Assignment data: the location, instructions, claims to be verified, messages, ratings and reviews.
- Evidence: photos, video, audio, notes and reports, with GPS location data and time stamps. These can include images of people, vehicles, premises and documents.
- Payment data: transaction records and payout details, handled through our payment providers. We do not store full card numbers.
- Technical data: device, IP address, app usage and cookies.
We do not ask for sensitive personal data (such as health data) except where needed for a specific assignment, for example a Visit Someone report. Where it occurs, we handle it with extra care and only with the required consent.
2. Why we use it and our lawful basis
- To create accounts, match Clients and Verifiers, and deliver assignments (performance of a contract).
- To verify identity, prevent fraud and keep people safe (legitimate interests and legal obligation).
- To process payments, refunds and payouts (contract and legal obligation).
- To handle disputes, enforce our terms and meet legal duties (legitimate interests and legal obligation).
- To improve and secure the Platform (legitimate interests).
- For marketing and non-essential cookies, only where you have consented. You can withdraw consent at any time.
Where we rely on consent, it is given by a clear active step and may be withdrawn, though withdrawal does not affect earlier lawful processing.
3. Consent, recording and third-party data
Evidence can capture people who are not HaliSite users. Verifiers are instructed to avoid capturing identifiable people where it is not necessary, to get consent where required, and never to record covertly or in restricted places. Clients must have a lawful reason for commissioning the evidence and must not misuse it. Visit Someone photos and video are taken only with the visited person’s consent. If you believe you were recorded unlawfully, contact us and we will review and, where appropriate, remove the material.
4. Who we share it with
- The Client and Verifier on an assignment, to the extent needed for the assignment.
- Service providers acting for us: hosting and storage, payment and mobile money providers, identity and background check providers, communications and analytics tools. They are bound to protect the data.
- Professional advisers, regulators, courts and law enforcement where the law requires or allows.
- A buyer or successor in a business transfer, subject to this policy.
We do not sell personal data.
5. Transfers outside Kenya
Some providers may store or process data outside Kenya. Where this happens, we will transfer personal data only as the Data Protection Act, 2019 permits, which includes adequate safeguards or your consent, and will keep to any local processing rules that apply to particular categories of data.
6. Retention
We keep personal data only as long as needed for the purposes above and the law. Typical periods: account data for the life of the account plus 1 year; raw assignment video 30 days and raw photos 90 days after the assignment closes; final reports 12 months after close, unless the Client asks for earlier deletion or a dispute is open; payment records 7 years; acceptance records the life of the account plus 6 years; vetting data while the Verifier is active plus 1 year, with identity document images deleted once verification is complete. We then delete or anonymise it.
7. Security and data breaches
We use access controls, encryption in transit and at rest where appropriate, secure storage for evidence, and staff and Verifier training. No system is perfectly secure. If a breach is likely to risk your rights, we will notify the Data Commissioner and, where required, affected individuals within the time the law sets.
8. Your rights
Under the Data Protection Act, 2019, you may ask us to confirm and give access to your personal data, correct it, delete it, restrict or object to processing, receive a portable copy, and withdraw consent. You also have the right not to be subject to a decision based only on automated processing that significantly affects you. Contact support@halisite.com. We will respond within the time required by law. You can complain to the Office of the Data Protection Commissioner at any time.
9. Children
The Platform is for adults only. We do not knowingly collect data from children, except incidentally in evidence (for example a child present at a visited location). Verifiers are instructed to avoid capturing children, and we will remove such material on request.
10. Record of acceptance and changes
We record your acceptance of this Policy and of each version, with the date and time. We may update this Policy and will give notice of material changes and, where required, ask for fresh consent.
